1. Commercial policy
1.1 The "seller" Têxtil Rarial Lda, headquartered at Avenida da Ramada nº 25, 4780-099 Santo Tirso, with NIF 500861323, through the Erago Home e-commerce platform, has products for sale on the website www.eragohome.com, with these products being available exclusively to end users ("consumers").
1.2 The "end customer" indicates the individual who acts/purchases outside of his/her business or profession. If you are not an "end customer", we ask that you do not make purchases on the online sales website www.eragohome.com.
1.3 Têxtil Rarial reserves the right not to process orders received from users who are not "end customers".
1.4 These general terms and conditions of sale exclusively regulate the offer, transmission and acceptance of orders made on www.eragohome.com between consumers of the Erago Home online store (www.eragohome.com) and the Seller (Têxtil Rarial, Lda).
1.5 The "end customer" must provide Têxtil Rarial with an email address, or data relating to another form of contact, that are correct and complete and accepts that Têxtil Rarial may contact him/her using this data, if deemed necessary.

 

2. How to order
2.1 To order from www.eragohome.com, the user must have an email account and their browser must be configured to accept cookies and pop-ups, in order to benefit from all the browsing conditions of the Erago Home online store.
Placing an order on www.eragohome.com is easy:
1. Find the products you wish to purchase;
2. Add the selected products to the Shopping Cart;
3. Complete the purchase (indicate the delivery address and billing address);
4. Select the payment option and accept the Terms and Conditions;
5. Review your order before sending the order;
6. Submit the order;
7. You will receive an order confirmation by email;
8. Make the payment for the order within a maximum period of 5 days.
Your order will be registered in the system when you select the "Pay" button at the end of the purchase process.
When Têxtil Rarial receives your order, a message with your order number and all the details of the order will appear on the screen. The purchase agreement is finalized at this point.

An order confirmation is sent to your email. We suggest that you print or download this copy for future reference.

We reserve the right not to accept your order, or to cancel it even after automatic confirmation of the order.

By submitting the order form, you are accepting the general conditions of purchase, as well as other conditions existing on www.eragohome.com, through links, including the general conditions and terms of use.

Têxtil Rarial may not process orders that do not have sufficient guarantee of good collection, when the orders are incomplete or incorrect, or the products ordered are no longer available. In the aforementioned cases, we will inform the customer by email that the sales contract has not been concluded and that we will not proceed with the sale, specifying the reasons for this.
If the products presented in the online store are no longer available at the time of your last access or when the order is received in our system, Têxtil Rarial will inform you of their unavailability within 5 days after receiving the order.

If an order and the respective payment were made for products that are no longer available, Têxtil Rarial will contact the customer to inform them of the situation and agree on the procedures to follow; ultimately, it will proceed to refund the money paid for the unavailable items.

2.2 Right to not accept the order or cancel the purchase
Têxtil Rarial reserves the right to refuse any order for any reason. We also reserve the right to cancel any purchase (even if it has already been accepted by us), (among others) in the following situations, exempt from liability for any damages or costs:

The product is no longer available/in stock (payments will be refunded);

The billing information is not correct or verifiable;

The order is flagged by our Security Systems as an incorrect order or an order susceptible to fraud;
The transfer for payment of the order has not been received by us within a period of 5 days after accepting your order;
If we believe that you are under 16 years of age;
If we believe that you are a reseller;
There is an error in the price quote;
It is not possible to deliver to the address provided.

2.3 Data verification
After receiving the order we may perform certain checks on it before preparing it.
These checks may include address verification, creditworthiness verification and fraud verification. In relation to fraud verification, we perform partially automated checks on all orders to filter out unusual, suspicious or identified fraud-prone transactions. Suspected fraud will be investigated and, if necessary, prosecuted. By confirming your order you signify your agreement to these conditions.

 

3. Guarantees and Product Price Indication
3.1 Payment Methods
Notifications of successful payment are received automatically by our services, so we do not need any proof of payment to be sent to us.

You can find details about the payment methods available in the Help/FAQ section of the website. We do not accept any other payment methods than those mentioned. Please do not attempt to pay by any other means than those specified. If you do so, we cannot be held responsible for loss of payment or any other damages that may result.

3.2 Payment processing
If you pay by Credit Card, we will deduct the amount due from your account as soon as your order leaves our warehouse. In this case, all details (e.g. card number or expiration date) will be sent via encrypted protocol to the company providing the remote electronic payment services, without third parties being able to access the information transmitted. This information will not be used by Têxtil Rarial except to carry out the necessary procedures for purchasing or refunding, in the event of a return, in accordance with the exercise of the right of return or to report cases of fraud to the police. The purchase price of the products and the shipping costs, as indicated on the order form, will be charged to the current account when the purchased products are actually shipped.

4. Order security
4.1 The www.eragohome.com store uses one of the most robust security technologies among the encryption platforms available.
Your payment information will be encrypted from the moment you log in, until your transaction is processed and will not be saved on a public server. Although we use encryption software, the security of information and payments transmitted over the Internet or via email cannot be guaranteed. Têxtil Rarial shall not be liable for any damage suffered as a result of the use of electronic means of communication, including, but not limited to, damage resulting from failures or delays in the delivery of electronic communications, interceptions or manipulations of electronic communications by third parties or by computer programs used for communications or transmission of viruses.

If you choose to pay by Multibanco Reference, we will begin processing the order after receiving payment. This may take several days. Once 5 calendar days have elapsed after placing the order and if we have not received any payment, it will be cancelled. Payments can only be processed if the information to be used for billing can be verified.

5. Reservation of Title
5.1 Têxtil Rarial retains ownership of the company's products until it has received full payment for all such products.

6. Prices
6.1 The prices of the products displayed on the website include/include Value Added Tax (ICMS). Shipping rates are applied per order. The exact price of the shipping fee will depend on the country and respective geographic location where your order will be delivered. For additional information on shipping fees per country, please refer to the Help/FAQ section of the website.

6.2 All prices are quoted in Euros. Please note that changing the delivery country may have an impact on the prices due to shipping costs.

6.3 Your total price
The total price specified in the final checkout menu includes taxes and shipping costs. Prices are quoted in the order confirmation, which you can print or download for future use. Please pay only the exact amount specified in the order confirmation and make individual payments per order.

6.4 Price changes
The prices of the products shown on the website are subject to change. Têxtil Rarial reserves the right to change prices without prior notice. The prices displayed at the time of purchase are the prices applied to that purchase.

6.5 Price errors
Please note that even though the website is updated with extreme care, it is possible that the price information on the website may contain errors. Têxtil Rarial is not committed to the offer and reserves the right to cancel your order in the event of such an error.

7. Quality and Warranty
7.1 Têxtil Rarial does not sell second-hand products, products with defects or products of inferior quality to those available on the market. The main characteristics of each product shown on www.eragohome.com can be found on each product page.

The products offered for sale on the website www.eragohome.com may not exactly match the physical pieces in terms of image and colors, due to the Internet browser and monitor used. All products have an identification label. Do not remove the label from the purchased product if you wish to return the purchased product. If you decide to exercise the right to return the purchased products, Têxtil Rarial has the right to refuse the return of products that are returned without the label or that have been altered from their original condition or damaged.

8. Shipping & Delivery
8.1 Delivery
The product shipping process takes place from Monday to Friday from 9 am to 7 pm. We do not ship on certain holidays. If no one is available to receive the order, it will be forwarded to the CTT post office closest to the original delivery address. In this situation, the carrier will leave a notice with the necessary procedures to claim your order. This service does not include the option of scheduling or booking, so the order will be delivered without prior contact by the carrier. We do not guarantee this deadline during periods of promotions, sales, Christmas and stock shortages.
A delivery is considered to have been made or a product is considered to have been delivered upon signature of the delivery receipt at the agreed address.

8.2 Shipping Deadlines
As soon as Têxtil Rarial is notified of payment for your order, it will make every effort to ship it the following business day (weekends and holidays are not considered business days). However, it reserves the right to ship within a maximum period of 5 days (except in the event of extraordinary situations such as promotions, sales, Christmas and stock shortages). Although we usually do this, we cannot guarantee timely delivery.

8.3 Partial Deliveries
We do not make partial deliveries of orders. If any product in the order is not available at the time of dispatch (for any of the reasons mentioned in the previous point), we will contact the customer by sending an email to deal with the situation in a personalized manner.

8.4 Inspection upon delivery
At the time of delivery, the customer must inspect the packaging to check for any damage. If the products are found to be damaged, the customer must not accept delivery of the order, which will be returned. Têxtil Rarial will refund the amounts paid for the order and shipping as soon as the warehouse receives and completes the return process.
Any claim for non-receipt of an order must be made within a maximum period of 30 days from the date of placing the order. After this period, Têxtil Rarial will not be held responsible for any loss of the package.

9. Returns & Cancellations
9.1 Cancelling an order before shipping
The customer may cancel an order, as long as it has not yet been shipped. If the customer places an order and wishes to cancel it, they must first check the order status using the Order History option available in the Customer Area, located in the top right corner of the website's home page. If the order status indicates "Payment" or "Preparation", there is a possibility that it will still be canceled. However, the customer must contact our Customer Service and request the cancellation of their order. If this request is successful, the customer will be notified by email of this decision and the cancellation will be processed at no cost to the customer. If the products have already been shipped, the cancellation request will not be viable; if upon receipt of the products the customer maintains their intention to cancel, they must refuse delivery. The products will be returned and, upon receipt, the refund will be processed.

9.2 Return of defective products
The customer has the right to return the products delivered if it is found that they have defects or other non-conformities in relation to the products ordered. The return can be made within 14 days after receiving the order and the product must keep the identification label. If your complaint is justified, the user will be reimbursed for the price and shipping costs. 9.3 Return of products due to withdrawal
If for any reason you are not satisfied with the products you ordered, you may return them within 14 calendar days after receipt, provided that:
They have not been washed or used;
The product maintains its original characteristics and the packaging is not damaged (carefully opened packaging will not be considered damaged);
The product is complete (e.g. all items in a set of towels must be returned);

You cannot return:
Products that have been tampered with and still have their identification tag.

9.4 Returns of gifts
We do not accept returns of products offered by someone else. In this case, to make the return you must contact the person who purchased the item, so that they can process the return in accordance with the Return Conditions.

9.5 Exchanging products
To exchange an item for another, you must contact us indicating your intention. The original product must be handed over to the carrier at the time of delivery of the new product. For more information, please consult the Help/FAQ menu on the website.

9.6 Information on refunds
If your return is justified by the existence of a defect or non-conformity with the products ordered, Têxtil Rarial will bear the shipping and return costs. If your return was made for reasons other than the justified existence of a defect or non-conformity with the products ordered, Têxtil Rarial will not refund the shipping costs. However, when making a return you will be using our shipping provider. Since the costs incurred by Têxtil Rarial to make the return are the same as the shipping costs, Têxtil Rarial will not refund the postage costs initially borne by the customer for the respective order.
The refund is made using the same payment method you used to place the order, and the amount is refunded to your credit card or Paypal account. If you paid by Multibanco reference, you will be asked by email for your IBAN for the refund.

9.7 In-store returns
Returns of products purchased on the Erago Home website are not permitted in the Dona Erago store network.

11. Conditions applicable to Promotional Codes (discounts)
11.1 When used in accordance with the established rules, a promotional code entitles the user to benefit from a promotion/discount related to the purchase of a specific product or for a set of products, during the period indicated/associated with the promotional code/promotional campaign.

11.2 Promotional codes can only be used for online purchases made on the website. The sale, exchange or donation of a promotional code is not permitted. The customer holding the promotional code may not upload or make available a promotional code on any website or other public form of gift, donation, sale or exchange. The use of promotional codes for commercial purposes is not permitted.

11.3 The promotional code is associated with the brands Erago Home, Dona Erago and Têxtil Rarial. The use of the promotional code in connection with other brands, companies or names is not permitted. The use of the promotional code in an illegal, abusive or disrespectful manner, as well as in any other way that may harm the reputation of Têxtil Rarial, is also not permitted.

11.4 The use of the promotional code is subject to one use per product and per order only. Promotional codes cannot be combined with any other promotions or special offers.

11.5 Promotional codes are not exchangeable / redeemable for money.

11.6 Têxtil Rarial is not obliged to reissue or refund promotional codes. However, in the event that Têxtil Rarial decides to reissue or refund a promotional code, it must have access to the initial promotional code. To do this, you must keep a copy of your promotional code, otherwise it cannot be reissued or replaced in the event of loss.

11.7 In cases where Têxtil Rarial reissues/refunds the promotional code, the discount of this amount may only be applied to a purchase of an equal or greater value than the purchase for which the discount/promotional code was issued.

11.8 Without prejudice to any other rights, Têxtil Rarial may have/has the right to immediately invalidate the promotional code if Têxtil Rarial has reason to suspect that a promotional code is being used: in violation of the aforementioned assumptions, by usurpation or in other cases where Têxtil Rarial has reason to do so.

12. Availability
All orders placed on the website are subject to availability. Têxtil Rarial tries to ensure that all items offered for sale on the website are in stock. However, Têxtil Rarial reserves the right not to accept any orders or cancel orders already confirmed for products that are no longer in stock. In such cases, Têxtil Rarial will inform the customer of this fact and will refund the amount paid.
13. Validity of the promotion
The offers on the website are valid only for the time they are displayed on the website, unless otherwise stated on the website. Têxtil Rarial is not bound by any offer if there are errors or mistakes in spelling, prices or other information on the website. Têxtil Rarial reserves the right to cancel any purchase and sale concluded under such errors.

14. Liability
14.1 Têxtil Rarial shall only be liable for damages suffered by the customer in the event that such damages result from breaches attributable to Têxtil Rarial’s contractual obligations towards the customer, or in the event that Têxtil Rarial’s liability results from applicable statutory law.

14.2 If the customer has suffered damages in connection with the activity of the website, Têxtil Rarial’s liability shall be limited to:
Damage to Têxtil Rarial’s products or other materials;
Reasonable and provable costs incurred by the customer in finding the cause and the amount of compensation attributable to the damage;
The maximum reimbursement of the aforementioned compensation shall be (if applicable) the price of the products in question.

14.3 Têxtil Rarial shall not be liable for damages suffered by third parties resulting from the use of any of our products. Têxtil Rarial shall not be liable for damages suffered by the customer as a consequence of the improper use of our products.

14.4 Têxtil Rarial is not responsible for damages resulting from incorrect information on the website.

14.5 In the event that the customer suffers damages resulting from gross negligence or willful misconduct on the part of Têxtil Rarial, none of the limitations set out in this article shall apply.

15. Applicable law
These general conditions and all disputes arising in relation to these general conditions, including their validity, the use of the website or any purchase on the same shall be governed by Portuguese law.

16. Amendment of the Terms & Conditions by Têxtil Rarial
Têxtil Rarial has the right to amend these Terms & Conditions at any time. The customer is subject to the principles and terms in force on the date of his/her order, unless the law or competent authority imposes any amendment to them.

17. Information on the website
Although Têxtil Rarial works its website with great care, the information, texts, graphic documents, films, music and/or other services may contain errors or be incomplete or incorrect. Têxtil Rarial cannot be held liable for any damages resulting from the use (or inability to use) the website, including damages caused by viruses or any inaccuracy or imperfection of the information, unless such damage is the result of intent or negligence on the part of Têxtil Rarial.

18. Trademarks and copyrights of the website
All brand names, product names and titles used on the website are trademarks or registered names of Têxtil Rarial or trademarks and registered names of other holders. The user/client of the website is not authorized to use or reproduce any of these trademarks or registered names as this constitutes a violation of the rights of the holders.
Everything relating to the design, texts, documents, films, music and/or other services of the website, the selection and arrangement thereof, as well as all software compilation (including applets) and all other materials on the website are the property of Têxtil Rarial and its suppliers. Users/customers are only authorized to electronically copy and print portions of the website if this is necessary to place an order on it or to use the website as a source for purchasing. The user/customer is not authorized to make any other use of the website or the information and materials contained therein, including reproduction for purposes other than those mentioned above, modification, distribution or republication. Should the user/customer wish to use information or materials from the website, he/she must obtain prior written authorization granted by Têxtil Rarial.
19. General Data Protection Regulation
The user authorizes the processing of personal data provided by the purchase order, in particular, by the use of cookies, under the terms set forth in the Legal Notices.
